We rented a house 3 years ago. Long story short, it developed a huge mould issue (through no fault of our own), S was seriously ill the entire time we lived there so we moved out early. The landlords have never repaid the deposit. The deposit is in the DPS (even thought it took them 2 months to put it in there!). At the time we asked for it all back as they agreed we could move out early, they refused it, we said we'd have half then. To be honest I hadn't done much more about it, I'd written to them around that time to request they enter the alternative dispute thing but they didn't.
Anyway, just sorting out our tenant's deposit and I checked out our account and it now says 'In single claim- awaiting lanlord stat dec'. Read the glossary but it's not helpful.
Being that all this is nearly 3 years old, is there not a maximum time the landlord has to provide evidence before we get the whole deposit back?

I don't know about there being a maximum time but it certainly seems to have gone on for long enough, I'd get in touch with the people that you need to get in touch with and try to get it back - I don't think he can claim it back without the evidence, he clearly hasn't bothered, so to my mind the money is yours.

This is my thinking. Will give them a call on Monday. That'd be a nice little bonus before Christmas if we do!
