Hi, just wondered what other people would do? I witnessed an accident last July or August between a lorry and a car driver and gave the car driver my phone number. The police were not called but the two people involved exchanged details. I have just been phoned and asked if I would attend court as a witness. I am not sure what to do. I have given evidence in court before after witnessing an assault the person who committed the assault was aquitted by the jury despite there being two independent witnesses, so I am not sure giving evidence is worth while. Secondly I witnessed the accident when my husband was very ill and he still has on going health issues and I may need to attend a hospital appointments with him which is far more important than giving evidence. Also I don't want to have to travel miles and take time off work. Finally I think the lorry driver was at fault however even if he is at fault I don't want it to destroy his livelyhood.

I don't know what I would do, but if I decided to give evidence the driver's livelihood wouldn't be on my conscience as I have known people who have died due to reckless lorry drivers and I wouldn't feel it my place to protect him, if you see what I mean. I'm sure if the dates clashed you would be able to move the court thing to when you could go, if you wanted to go, that is. Tough one.

Thank you, I had a chat with my husband and after thinking things through I have given a statement and have agreed to go to court if needed. The court case would be local and not take long. I did explain the situation with husband and have been reasured that if my husband is in hospital then I would not have to attend.

I think you have done the right thing and good that you also explained about your husbands health situation too
