I have just spoken to my HR dept as they haven't yet sent me confirmation of my maternity leave and I;m not sure whether the dates are correct or not?
I am currently using up my annual leave , last day being FRiday 3 May.
HR are then saying that my maternity leave commences on Saturday 4 May (specifically says in our policy that mat leave can start on any day, doesn't have to be a Sunday).
I;m not sure this is correct though. Obv there is the weekend, plus I don't work on Mondays (and the 6th happens to be the BH) so I think my official mat leave starts on the 7th.
I'm sure their arguement will be that there can't be a gap and that ML has to immediately follow AL so I am wondering if my 'last day' should therefore have been the 6th?
I feel like I am losing out on 3 days but can't quite articulate why!
My HR dept are useless and I will really need to spell it out to them if this is the case.
ANy thoughts in who's right and who's wrong?

I can see where you're coming from, it seems like it should start from the Tuesday. Maybe you say you want ML to start from the Tues and will use AL before then they'll understand it more.
What is your EDD though, as it can't be any later than that day.

Without having any knowledge of it in a HR capacity I would say that your ML would start Tuesday 7th May, if you dont noramlly work Sat-Mon then you dont need to take them as AL or ML surely?

Morph...mine is the same as yours..i finish here next Friday but my first week is annual leave. My maternity leave starts on 7th May and i have this in writing from my HR department. I informed them that this was my requested start date of mat leave when i put it in writing with my MAT1b form.

My maternity leave started on my due date which was a Sunday. Even if I don't work weekends I'm still 'employed' on those days so maternity leave can start on any day of the week and should start the very next day after your holiday ends.

My maternity leave has to start on a sunday and as my EDD is a sunday i think that I will be starting it from the week before I am due.

PoppySeeds, they can't make you start your maternity leave on a Sunday. That is very very old legislation, changed around 2004/5 when I was working in HR. Clearly if your EDD is a Sunday anyway then it isn't going to affect you but might be worth raising it with them.

Mine is starting on a Monday, I left work yesterday, today is annual leave and my contracted days are mon - fri so I think you are right in your thinking, though I'm no HR expert!

You definitely don't have to start your Mat leave on a sunday - it can now be any day but some payroll depts are lazy and do it because they think it's easier (not sure why!)
Morph that is a strange day to do it, if you finish on a friday your Mat leave should start on a Monday (assuming you have weekends off) so for bank holidays the Tuesday. The only thing that may be complicating it for them is how they calculate your holidays - for some part timers they add bank hols into your full entitlement in which case you would need to book the extra day for it to start on the Tuesday or start it on the Monday despite it being a bank holiday.
