Hi. Does anyone know where you can find out about SML over 39 weeks? I'm just interested to know what the 'rules' are on 52 weeks ML. Thanks.

It's not SML at that point, it's AML. You can take it off but it is unpaid, and if you have any company benefits they can also be taken away for the final 13 weeks. What else do you want to know?

OB I was wondering if its the change from going back at 39 weeks to going back at 52 that means you are under risk of going back to work but not to your old job etc? I'm sure there use to be something on the government website about it but can't find it now.

I believe if you go back during OML (the first 6 months) you have the right to return to the same job. Anywhere after that, be it after the 9 months, or the full 12, you have the right to return to a similar job. This is from memory though so I'm not 100%.

Carole - Thanks, thats where I have been looking but unfortunately it doesn't help with what I'm trying to work out at the moment :-(
OB that is really helpful, thanks. I didn't realise that it was any time during the AML that your position (and thus salary?!) could be altered.

I don't think they can alter the salary! I'm sure it said similar job, same benefits. Sorry, I've got a memory like a sieve!

Its similar benefits rather than same according to that link I just posted.
Anyway, I don't even need to know yet, just daydreaming about when I do need to know! Ha!
