One of my mummy friends handed her notice in at work today as they are moving out of he area. She started her Maternity Leave beginning of August last year. Her company are notoriously rubbish at getting things right HR-wise and when I mentioned to her that she ought to be getting any accrued holiday and bank holidays paid by them she asked if that would be at maternity leave rate or her normal pay rate.
I'm not sure so thought I was ask here to see if anyone knew more about it than me! I would think she has August, Christmas, Boxing Day, New Year Day, Good Friday and Easter Monday due to her, in addition whatever leave she has accrued. So how does it work if you resign? When I went back they rolled over to increase my holiday entitlement.

You should be paid at your full rate for bank holidays as to do otherwise would be discrimination (assuming the other employees at her workplace get paid in full for BH's and don't have to work them). Usually they are added as holiday days to the beginning/end of mat leave but if you resign they should be added to any holiday you have accrued and you should be paid for them accordingly. Does that make sense?
ETA - there are 8 BH's in a standard year (9 last year due to the Jubilee extra)

Hi. Sorry to hijack but can I just check - if you take maternity leave and there is bank holidays during that time which you would normally get off (paid), should employees give you the holiday days for it when you get back, ie extra days annual leave because you were on maternity leave during a bank holiday? Anyone know where it states this by law? Thanks

Very confusing. Especially if you don't usually get the option of working bank hols, I.e you get them off because the company doesn't work bank holidays so no one can opt to work and take the leave at another time.

So if you are paid full pay for maternity leave anyway you don't get anything 'extra' for the bank holidays?

My mat leave started January and ended December (very convenient!). At the end of my 9 months paid mat leave, I took my 22 days holiday plus 8 BH days that I accrued for the year I had off.

I resigned at end of my maternity leave as employer couldn't/wouldn't offer any manner of flexible working. I was paid all bank hols accrued over this period in full in my final pay at my ful rate. I would gave been entitled to holiday at this time too but I'd opted to.use all accrued holiday at the beginning of mymaternity leave at my full rate instead x
